No they can't. Leagal separation means living apart. Living apart means not in the same home. If you live in the same home you make your separation null and void.
I know more divorces are happening where people stay in the same house. (This is because of the economy) I would imagine so; however, I would go down to your local courthouse or see a paralegal and ask.
cant say specifically about NY, but in most places physical seperation for at least 2 months is a must
