Foreigner getting married to an American?

I am a Nigerian studying in Poland. I found this American girl I love and we are planning to get married by early December when she comes visit me here in Poland.


Please how and whats the best way for her to get me over there by next year. She is 18 and has a child, also I am transfering my credits over there to be with her.

Well, if you get married, she would have to file an I-130 immigrant visa petition for you, but she would have to return to the US and file it here. If you're married, she can't file a fiance petition for you, but in order to file the fiance petition, she woud have to actually meet you first and then file in the US afterwards. It takes US immigration quite a while to process the paperwork and then send it on to the embassy in Poland. The entire process can take up to a year, or more. Eventually, you'd be scheduled for an interview at the embassy where your visa would be adjudicated. The visa is not automatic after the petition is filed, you would have to pass the interview, submit police clearances from Poland and Nigeria, etc. The fact that your fiancee is so young may make it more difficult to qualify as she has to file an affidavit of support to show she has the ability to support all three of you above the Federal Poverty guidelines. Might be hard for an 18 year old single parent to do that. your best choice is to do the fiance visa because it allows you to come in and do the process in the USA after the wedding.
Once married you are entitled to a open visa to the United States. You'll need to see the American Council for details. The one thing you had better check out with them first is will the United States recognize your marriage certificate as being valid for proof of marriage for the purpose of entering the United States?





Also, it sounds like you met this person over the Internet and when she visits in December this will be your first meeting. The United States may just consider your marriage a matter of convenience for you and require more substantial proof that you two are serious about each other and not just trying to get you in the US by a crooked way.

I think the fastes way is for her to get back to the States and file for a Fiancee Visa for you! It's a lot fatster than get married in Europe and wait for a spouse visa! Good Luck
if you want to come to US asap, you can apply for a fiance visa. it takes about 8 months. you will have an interview (after a year or two) to receive a temporary green card. it's a tough interview, you will have to prove your relationship and all...


Since so there are so many fake marriages, the interview is getting tougher and tougher.


If you want to avoid that interview. have your wife petition you as her spouse. it will take anywhere from 2-3 years for you to get a visa. you will receive your greencard at the airport when you enter the US

This is not an easy task consider your girlfirnd is only 18 yrs old. To get you a fiance visa and go to US, that is an easy part. After you get married in US, the problem is she needs to sponsor you for green card so you can live in US.





If her income is above 125% poverty line, she can sponsor you; otherwise she has to find a relative that is willing to sponsor you. So take this into consideration.
